Terms of Service
The agreement between you and AnnexHub when you create an account, run events, sell tickets or check guests in with it.
Effective
These terms are a contract between you and Annex Creative Solutions (M) Sdn. Bhd. (company no. 202301005655 (1499574-X)), the company that runs AnnexHub. In these terms “AnnexHub”, “we” and “us” mean that company, and “you” means the person or organisation using AnnexHub.
By creating an account, clicking to accept, or using AnnexHub, you agree to these terms and to our Privacy Policy. If you use AnnexHub on behalf of an organisation, you confirm that you have the authority to bind it, and “you” includes that organisation.
1. Who can use AnnexHub
You must be at least 18 years old and use AnnexHub for a business or organisation. You may not use AnnexHub if we have previously suspended or closed an account of yours for breaching these terms.
2. Your account
- Give us accurate details and keep them up to date.
- Keep your password and sign-in secure. You are responsible for everything done through your account, including by team members and by event staff you give scanner access to.
- Tell us straight away at support@annexcs.com if you think your account has been compromised.
3. What AnnexHub provides
AnnexHub gives you registration pages and forms, QR tickets and ticket email, door check-in through the staff scanner (including a queue for scans made offline), attendee management and exports, and, where enabled for your account, paid ticketing.
We may add, change or retire features. If a change removes something you rely on, we give reasonable notice. Features labelled beta or preview are provided as they are and may change or disappear without notice.
4. Plans, fees and payment
- Free tier. What it includes is described on the pricing page. We may change the free tier with notice.
- Paid tiers and event passes are priced in Malaysian Ringgit (RM) as shown on the pricing page or in your written quote. Card payments are processed by our payment processor. Invoiced customers pay within the term stated on the invoice.
- Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from the billing page; access continues until the end of the period you have paid for.
- Event passes and per-event credits apply to one event. Once a credit has been applied to an event, or a subscription period has started, the fee is non-refundable except where the law requires a refund or we agree otherwise in writing. A credit you have bought but not yet applied to any event is refundable on request within 14 days of purchase.
- Price changes. We give at least 30 days’ notice by email. New prices apply from your next renewal or purchase.
- Taxes. Prices exclude sales and service tax and any other applicable tax unless stated. We add tax where the law requires.
- Failed or late payment. After notice, we may suspend paid features until the outstanding amount is paid.
5. Paid ticketing for your events
When paid ticketing is enabled on your account, your attendees pay in Malaysian Ringgit through our payment processor’s hosted checkout page, and the payment is collected by us on your behalf.
- You remain the seller of the tickets and the organiser of the event. You set the ticket price, describe what the ticket includes, set the refund and cancellation policy for your attendees, and handle any consumer, tax and licensing obligations for your event.
- We remit ticket proceeds to you, less the fees and payment processing charges agreed in writing when paid ticketing was enabled for your account, on the schedule in that agreement.
- Refunds you issue to attendees are made through AnnexHub and deducted from your proceeds. Chargebacks and payment disputes are also deducted, and you agree to give us the information we need to respond to them.
- We may withhold proceeds where we reasonably suspect fraud, and we may hold a reserve against chargebacks for up to 90 days after your event.
6. Your content and attendee data
You own your event content and your attendee data. You give us a licence to host, copy, transmit and display it as needed to run AnnexHub for you.
For attendee data, you are the data controller and we are your processor. You are responsible for having a lawful basis to collect it, giving attendees a privacy notice, asking only for what you need, and answering attendee requests about their data. We will process attendee data only to provide the service to you, keep it secure, use only the categories of provider described in the Privacy Policy (the named list is available to you on request), help you respond to attendee requests, and delete or return it when your account closes. The Privacy Policy forms part of these terms and sets out those processing commitments.
Do not collect sensitive personal data through AnnexHub (health, religion, biometrics, identity card or passport numbers) unless your event genuinely needs it and you have the attendee’s explicit consent.
7. Acceptable use
You agree not to:
- run events that are unlawful, fraudulent or misleading, or that infringe someone else’s rights;
- send unsolicited email through AnnexHub. Only contact people who registered for your event or otherwise agreed to hear from you;
- upload malware, scrape the service, probe its security, or overload it;
- resell AnnexHub, or use it to build a competing product;
- impersonate another person or organisation;
- break any law that applies to you, including data protection, anti-spam and consumer protection law.
8. Intellectual property
The AnnexHub software, design, guides and brand belong to us. You get a limited, non-exclusive, non-transferable right to use them while you have an account. If you send us feedback or suggestions, we may use them without any obligation to you.
9. Third-party services
Google sign-in, our payment processor and the other providers described in the Privacy Policy have their own terms, which apply to your use of them. Payments are subject to the payment processor’s terms shown at checkout. We are not responsible for third-party services we do not control.
10. Availability and support
We make commercially reasonable efforts to keep AnnexHub available, and we schedule maintenance with notice where we can. We do not guarantee uptime unless you have a written service level agreement with us. Support is by email during Malaysian business hours.
Your event still depends on your own devices, network and staff. The offline scan queue reduces the risk of a network failure at the door but does not remove it; for critical events, keep a printed guest list as a fallback.
11. Disclaimers
AnnexHub is provided “as is” and “as available”. We do not promise that it will be uninterrupted or error-free. We are not responsible for your event, for the conduct of your attendees, or for outages at third-party providers.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, lost profits or revenue, loss of data beyond our backup commitments in the Privacy Policy, or the cost of cancelling or re-running an event. Our total liability to you for all claims in any 12-month period is limited to the greater of the fees you paid us in the 12 months before the claim and RM 500.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under Malaysian law, including liability for fraud or for death or personal injury caused by negligence.
13. Indemnity
You will indemnify us against claims, losses and costs arising from your event, your content, your ticket sales, or your breach of these terms or of the law, including claims brought by your attendees.
14. Suspension and termination
You may close your account at any time by emailing support@annexcs.com. We may suspend or close your account for a material breach of these terms (with notice and a chance to fix it where that is practical), for non-payment, or where continuing would create a legal or security risk.
When your account closes you have 30 days to export your data. After that we delete it as described in the Privacy Policy. Sections that by their nature should survive, such as fees owed, liability, indemnity and intellectual property, continue to apply.
15. Changes to these terms
We post the new version on this page with its effective date and email account holders at least 14 days before a material change takes effect. Continuing to use AnnexHub after that date means you accept the new terms. If you do not agree, close your account before the change takes effect.
16. General
These terms, the Privacy Policy and any written quote or order form make up the whole agreement between us. If part of these terms is found unenforceable, the rest still applies. Not enforcing a term is not a waiver of it. We may transfer this agreement to a successor of our business; you may not transfer it without our written consent. Notices go by email, to the address on your account and to support@annexcs.com. The English version of these terms governs.
17. Governing law
These terms are governed by the laws of Malaysia. The courts of Malaysia have non-exclusive jurisdiction over any dispute.
